Terms and Conditions of Sales

READ THIS DOCUMENT THOROUGHLY.  IT CONTAINS IMPORTANT INFORMATION WITH REGARD TO YOUR RIGHTS AND OBLIGATIONS,
AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
 

This Agreement contains the terms and conditions that apply to purchases made by customers from Dive & Glide, Inc. Dive & Glide, Inc. reserves the right to revise or modify these terms and conditions at any time without prior notice.  Your use of the Dive & Glide, Inc. website and/or the acceptance of a purchase delivery constitutes your unconditional agreement to follow all terms and conditions set forth in this Agreement.   THESE TERMS AND CONDITIONS MAY NOT BE MODIFIED, ALTERED, SUPPLEMENTED OR AMENDED.  ANY ATTEMPT TO CHANGE THE TERMS OF THIS AGREEMENT WITHOUT THE KNOWLEDGE OF DIVE & GLIDE, INC. WILL NULLIFY AND VOID ANY ASSOCIATED SALES ORDER.

APPLICABLE LAW.  This website is designed, created and operated by Dive & Glide, Inc. in the State of Michigan.  As such, laws of the State of Michigan will govern disclaimers, terms, and conditions.  Dive & Glide, Inc. reserves the right to make changes to our site, disclaimers, terms and conditions at any time.

CANCELING YOUR ORDER.  You may cancel your order for any reason prior to it leaving our facility at no charge.  If you cancel an order that has already shipped, you will be responsible for all shipping charges incurred.  This includes the cost of shipment to you, as well as all shipping charges incurred to return the items to our facility.  If you have not already received the item at the time you cancel your order, and the order is still in transit, we will do our best to have the shipment re-routed back to us to incur the smallest shipping charge possible.  If you have already received your shipment and wish to cancel your order, you will need a Return Authorization Number (RA#) from us to do so.  Please call 877-DIVE-747 to receive your RA#.  Once you are issued a Return Authorization Number, it is your responsibility to re-package (if necessary) and insure items for return delivery to Dive & Glide, Inc.  within 10 business days.  As long as items are returned in new condition without damage and accompanied by all original documentation, you will be credited/refunded your full purchase price, excluding only shipping charges.   Due to copyright laws, we can not refund the purchase of any DVD, CD, Book or Video Tape that has been opened. 

CONFIDENTIALITY & PRIVACY.  The confidentiality and privacy policies set forth here are for this website only.  If you follow a link to another website, please review their policies.   We will not sell or share your personal information with any third party, with the exception of sharing information with governmental agencies or other companies for the purposes of fraud prevention and investigation or for  confirmation of  warranty information with manufacturers/suppliers when applicable.   No information is provided to any entity for marketing or sales purposes unless specifically requested by you.   At the time of Order Verification, you will be asked if you are interested in being added to Dive & Glide's mailing lists (email or US mail).  If you say "No", you will not receive solicitations from Dive & Glide, Inc.  We will only communicate with you with regard to your order.

COPYRIGHTS AND TRADEMARKS.  All content on this website, including text, logos, graphics, pictures, button icons, and software is the property of Dive & Glide, Inc.  or its content suppliers and is protect by U.S. and International copyright laws.  The production of this website and all its contents is the sole responsibility of Dive & Glide, Inc. and therefore is exclusively owned by Dive & Glide, Inc. and is protected by U.S. and International copyright laws.  Software used on this website is property of Dive & Glide, Inc. and/or its supplies and is protected by U.S. and International copyright laws.  The reproduction, modification, transmission, display or republication of any part of this website is prohibited.

CUSTOMIZED ITEMS / ORDERS.   Special Order Customized Items, such as wetsuits, dry suits, prescription lenses, are FINAL SALE and NON-REFUNDABLE.  It is not uncommon for Special Order Items to take extensive delivery times.  Please call 989-DIVE-747 for information on placing an order for a customized item and estimated availability date and charges.

DISCLAIMER.  Some of the equipment on our website should only be used by certified SCUBA divers.  Dive & Glide, Inc. DOES NOT ACCEPT RESPONSIBILITY FOR THE USE OF DIVING EQUIPMENT BY NON-CERTIFIED OR NEGLIGENT DIVERS.  We can not be held responsible for your consumer use of products ordered/purchased from Dive & Glide, Inc.  We do not necessarily know what your intended use of the product is, and therefore can not take responsibility for your well being during the use of items purchased by you.  USE COMMON SENSE!  Products should be used only for the purposes for which they were designed, and by individuals who are trained the in the proper use of said products.  Dive & Glide, Inc. makes no representations or warranties of any kind, expressed or implied, as to the operation of this site or of the information, content, materials, or products found in this website.  To the fullest extent allowed by applicable law, Dive & Glide, Inc.  disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.  Dive & Glide, Inc. will not be liable for any damages of any kind arising from the use of this site, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

GENERAL INFORMATION - CATALOG PHOTOS & MISPRINTS.  We strive to provide in our on-line catalog the most up-to-date product information, prices and photos as provided by the manufacturer.  Every effort is made to provide information that is clear, concise and error-free.  We are responsible for correcting misprints and price information as necessary.  Pictures and/or illustrations are provided for reference purposes only and may or may not reflect the exact colors, sizes or configurations.  All product sizing, styles and color information provided on our website, is as per manufacturers specifications.  In most all cases, you will find that the product description in our catalog links you directly to the manufacturer website and their description of the product.  This is the best place to find product size charts, color options, styles, customization and add-ons.

GENERAL INFORMATION -  ITEM AVAILABILITY.  All products in our catalog offered for sale are subject to availability.  Occasionally a product may be discontinued or changed.  We strive to keep information in our catalog as current as is possible, however, if an item in you order has been discontinued or changed, we will advise you immediately.  We can work with you to find an acceptable substitute or refund you the purchase price of the unavailable item.   

LINKS.  Dive & Glide, Inc. is not responsible for the content of any third party site and does not make an representations regarding the content or accuracy of material on said sites.  When you link to any third party website you are doing so at your own risk.

RETURNING OR EXCHANGING PRODUCTS.  All products, excluding customized items, may be returned to Dive & Glide, Inc. within ten (1) business days for a full refund, excluding shipping charges.  Exchanges for size, style or color changes will incur only shipping fees, unless the replacement item costs more or less than the original item.   You will be billed or reimbursed the difference, whatever the case may be.  Original documentation and packaging must be returned with the item for a full refund.  If you'd like to return an item for any reason, you will need a Return Authorization Number (RA#).   Call 877-DIVE-747 for details or to obtain a RA#.   Returning Defective Products:     If you have found a product to be defective during use, which may be several weeks or even months after your purchase, call us.  We will send you a replacement at no charge upon receiving the defective product and all necessary documentation back from you.  We'll even cover the shipping fees for the defective product.  Call 877-DIVE-747 to obtain you RA#.   To Return Items to Change Size, Color or Style:     If you are unhappy with any items in your order upon receipt, call us at 877-DIVE-747 to advise us of needed changes and obtain you RA#.    If you'd like to exchange or return an item for reasons such as size/color/style, you must contact us within ten (10) business days of receiving your order to advise us of the change.  You will incur charges for the replacement product as noted above.  If you do not contact us within 10 days for these changes, re-stocking fees may apply to your return.  Once you are issued a RA#, it is your responsibility to re-package and insure items for return delivery to Dive & Glide, Inc.  within (ten) 10 business days.  As long as items are returned in new condition without damage, you will be credited/refunded your full purchase price, excluding shipping and up-charges as applicable.  Merchandise returned without authorization or in used condition will not be accepted.   Due to copyright laws, we can not refund the purchase of any DVD, CD, Book or Video Tape that has been opened.

REVISING AN ORDER.  Orders may be revised for up to 48 hours after Order Verification at no charge.  If changes to an order occur after 48 hours, shipping charges may be incurred if the product has already left our facility.   We are available Monday-Friday from 10am-5pm EST, Saturday from 10am-5pm EST, and Sunday from 1pm-5pm EST.

RISK OF LOSS / OWNERSHIP TITLE.  Risk of loss and title for products ordered and purchased at Dive & Glide, Inc. passes to you at the time you receive our shipment from the delivery/freight company.  This means Dive & Glide, Inc. holds title/ownership to all property until it is delivered to you in new condition.  We will deal with all damaged shipment claims.

SITE SECURITY.  Interference with the workings of this site is prohibited.

SHIPPING.  Products will be shipped  "F.O.B. Destination - Freight Pre-Paid".  This means that although you pay shipping for your order, Dive & Glide, Inc. retains title/ownership of the products until they reach you in new condition.  Shipping damages and claims will be handled by Dive & Glide, Inc.  If your order arrives in damaged condition, simply call us.  We will arrange for the damaged items to be picked up and will have replacement products sent to you as soon as possible/available.  Orders are processed in the order that they are received.   We will ship your product (s) the cheapest way possible based on your requirements and available shipping options.  We recommend Ground Shipping as it is the cheapest option available.  But we can also quote you prices for RUSH SHIPPING at the time we verify your order.  Shipping rates quoted at the time of your order are estimates of your shipping charges.  You will not be charged for shipping until after your items have already been shipped out and actual shipping charges are known.  If actual shipping charges exceed the quote we have given you by 10% or more, we will cover the additional cost.   When an order is complete depends on whether the item (s) are in-stock, in-transit to our shipping location, on backorder, etc.  We will advise you of the soonest possible completion date for your order when we complete your order verification.  We ship out items Monday - Saturday to addresses within the contiguous United States only.  You will be billed actual shipping charges only.  We do not charge any additional service or handling charges.  If actual shipping charges exceed the quote we have given you by 10% or more, we will cover the additional cost.

TAXES;  PRODUCTS NOT FOR RE-SALE.   All sales to MICHIGAN residents will be taxed six percent (6%).  For tax exempt entities, we must have tax exempt documentation on file before sales tax exemption will be reflected on your invoice (s).  Items on this website are not for re-sale, they are for direct sale to the consumer only.  Purchase of products from this site for resale is prohibited.

TERMS OF PAYMENT.  Unless otherwise agreed upon between Dive & Glide, Inc. and the Buyer, full payment must be received prior to shipment of product (s).  Payment may be made by Visa™, MasterCard™, Discover™ and American Express™ credit cards, check and money order.    We do not take credit card information over the internet at this time.  We will confirm your credit card information, if this is the payment option you choose, when we complete your Order Verification by phone.   To protect against credit card and identity fraud, all orders are verified prior to shipping.  This process can take 24-48 hours for credit card orders and as much as ten (10) business days for business and personal checks.  Processing time may be delayed even more  if any information provided is incorrect or can not be verified.

USE OF OUR SITE.  This site is designed for personal consumer use only.  Commercial use of this site is prohibited.  You may use information from this site for shopping purposes only.

VERIFICATION OF ORDER.   To protect against credit card and identity fraud, all orders are verified prior to shipping.  This process can take 24-48 hours for credit card orders and as much as ten (10) business days for business and personal checks.  Processing time may be delayed even more  if any information provided is incorrect or can not be verified.  Orders are processed in the order that they are received.   We will contact you within 48 hours of receiving your order to do an Order Verification By Phone to review all information you provided and obtain your payment information.  We will also advise you of the estimated completion time of your order, shipping charges and estimated delivery date.   Complete processing of your order will take a minimum of 48 hours for credit card orders and up to ten (1) business days for orders paid for by business or personal check.  Most items are available for shipment immediately, or within (1) week, so your order should be ready to ship within 2-5 business days, provided all payment information provided is verifiable. 

WARRANTY STATEMENT.    Dive & Glide, Inc. is a retailer and an Authorized Dealer all products found on our website.  Items purchased will come with full manufacturers warranties.  We promise all products you purchase will be accompanied by instruction manuals printed in English.   Limited warranties from manufacturers accompany the product (s).  It is the Buyer's responsibility to complete and submit all warranty documentation.  We can review all product maintenance guidelines and warranties with you to assure you understand your responsibilities with regard to care and maintenance of your equipment, and how it relates to your product warranties.  Dive & Glide, Inc. does not warranty products.  Service work performed by Dive & Glide, Inc. is covered by a one (1) year warranty.  Dive & Glide, Inc. and its suppliers are obligated to honor warranties on paid-in-full products only.
